ELIGIBILITY: The Giveaway is only open to persons who are 18 years of age or older and a resident of the state of Hawaii at the time of entry. To be an eligible entry, entrant must not have won a prize in any Bank of Hawaii sponsored contest within the last 6 months. Employees of Bank of Hawaii, its parent, affiliates and subsidiaries (“Sponsor”) along with members of their immediate family and/or those living in the same household are not eligible. Void where prohibited or otherwise restricted by law. The Sponsor is solely responsible for all aspects of the Giveaway and for determination of eligibility. All entry information must be complete and accurate. Sponsor will not award a prize to anyone not meeting eligibility requirements at the time of entry. Sponsor reserves the right to disqualify any entrant if these Official Giveaway Rules are not followed. By entering this Giveaway you agree to the terms and conditions of these Official Giveaway Rules and make all of the Representations and Warranties as provided below.

HOW TO ENTER: To enter Bankoh Best Seats Giveaway, you must:

1. Login to your Instagram account.
2. Follow Bank of Hawaii’s official Instagram account.
3. Comment on the applicable Bankoh Best Seats Giveaway post with the hashtag #BankohBestSeats and tag a friend.

Limit one entry per Instagram account, per person, per Bankoh Best Seats Giveaway. Multiple comments will not result in additional entries. Any individual found using multiple accounts to enter will be ineligible. Entries are accepted between posting date for that Giveaway and the date and time indicated in that post. All times in these Official Giveaway Rules refer to Hawaiian Standard Time/HST and Sponsor’s computer shall be the official timekeeper for matters related to this Giveaway. Sponsor is not responsible for incomplete, lost, stolen, damaged, illegible entries or for address changes of entrants. An entry is only good for the applicable Bankoh Best Seats Giveaway post you comment on, and will not be carried forward to any future Bankoh Best Seats Giveaway. Any comment deemed to be offensive or abusive may be deleted and disqualified by Sponsor in its sole discretion without notification to entrant. Sponsor reserves the right to disqualify anyone who disputes any decision made by Sponsor.

ENTRY PERIOD: Entries will be accepted from the time the posting is made available on Instagram until the date and time indicated in that post.

PRIZE: The two (2) winners that are 18 years of age or older will each receive four (4) vouchers, each of which may be exchanged for one (1) ticket to an upcoming University of Hawaii (“UH”) men’s or women’s basketball, men’s volleyball and/or baseball game. Each winner may redeem one (1) or more vouchers for the game(s) and date(s) of their choice, subject to availability. Requirements, terms and conditions, and redemption instructions are contained on the voucher. Once vouchers are redeemed for tickets, no exchanges may be made. No compensation will be made for unused tickets or vouchers. Use of tickets is subject to terms and conditions and requirements of the University of Hawaii and the Stan Sheriff Center. Any costs associated with accepting and/or claiming the prize, including but not limited to transportation to and from the games are sole responsibility of the winner. Odds of winning depend on the number of eligible entries received during the Entry Period. Vouchers have no cash value, but approximate minimum retail value for each ticket received in exchange is $10 and value depends on the sport and date of game chosen.

WINNER SELECTION & NOTIFICATION: A random drawing to determine the winner(s) will be conducted on the timeline indicated on the Giveaway announcement post from among all eligible entries. Winner will be notified via Instagram Direct Message and must respond in the manner instructed in the Direct Message. Winner will be required to exchange vouchers for tickets at the UH Athletics box office. If the potential winner cannot be contacted, Sponsor will award the prize to an alternate winner if time permits. The prize will be awarded only to the owner of the Instagram account regardless of who may have commented on the post while accessing the owner’s Instagram account. Prize is not transferrable. Winner is responsible for making appropriate travel arrangements to the Stan Sheriff Center at the appropriate time of the game and any costs associated with accepting the prize.

CONDITIONS AND RELEASE OF LIABILITY: All participants agree (a) to release and hold harmless Sponsor and Instagram and their respective parent and affiliated companies and their respective officers, directors and employees (“Released Parties”) from any liability for any injury, loss, illness, litigation or damage that may occur directly or indirectly and whether caused by negligence or not from participant’s participation in the Giveaway or acceptance, possession, or use or misuse of the prize or any portion thereof; (b) to indemnify Released Parties from any and all liability for copyright, trademark or other intellectual property infringement claim as well as any other liability resulting or arising from the Giveaway; (c) to hereby acknowledge that Released Parties have neither made nor are responsible in any manner or liable for any warranty, representation, or guarantee relative to the prize; (d) that if selected as the prize winner, to the posting of such Winners’ name on Sponsor’s website and the use by Released Parties, photograph, voice, image, and/or likeness for publicity, promotional, and advertising purposes in any and all media now or hereafter known, throughout the world in perpetuity, without additional consideration, notification, permission or approval; and (e) to be bound by these Official Giveaway Rules and to waive any right to claim any ambiguity or error therein or in the Giveaway itself, and to be bound by all decisions of Sponsor which are binding and final.

GENERAL: Sponsor has the sole power and absolute discretion to terminate or modify any part or all of the Giveaway at any time, for any reason and without prior notice, and to interpret the rules and make decisions regarding the interpretation of the rules. Any modifications to these general rules shall be posted at http://www.boh.com/bankohbestseats. All decisions of Sponsor in respect to this Giveaway and interpretation of these Official Rules are final and legally binding and conclusive in all matters. No participant or winner shall have any right to challenge or contest any decision of Sponsor concerning the Giveaway, its rules, interpretations, determinations, eligibility, verification, timeliness, winners, prizes or any other matter. All federal, state and local laws and regulations apply. Taxes are winner’s sole responsibility. Winners may be required to complete an Affidavit of Eligibility/Liability Release and a Publicity Release at the time the prize is accepted Prize winners may be required to execute additional releases. By entering this Giveaway, winner consents to the use of his/her name, photograph, voice recording and likeness for publicity purposes without additional compensation or permission, except where prohibited by law. Neither Sponsor nor any partner nor any advertising and promotion agencies, nor any service providers are responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any service, or any other error or malfunction, or for late, stolen, lost, postage due, illegible or misdirected entries or mail, or for transactions that are processed late or incorrectly. Entry materials that have been tampered with or altered are void. Activity deemed abusive or improper by Sponsor, in its sole discretion, will result in disqualification from Giveaway. Sponsor reserves the right to substitute a prize of comparable value at its discretion. If Sponsor in its sole discretion, deems that Giveaway cannot be fairly conducted for any reason, it may terminate or modify any part or all of the Giveaway without notice. If any part or all of Giveaway is terminated, Sponsor may select winner from eligible entries received prior to the date of termination. By entering this Giveaway, each entrant accepts and agrees to be bound by these Official Rules. The Bank of Hawaii name is a registered tradename of Bank of Hawaii Corporation.
