Official Rules

NO PURCHASE OR PAYMENT TRANSACTION NECESSARY TO ENTER OR WIN.  VOID WHERE PROHIBITED OR RESTRICTED BY LAW.  GIVEAWAY SUBJECT TO ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS.  A PURCHASE OR PAYMENT TRANSACTION WILL NOT IMPROVE YOUR CHANCE OF WINNING.

THIS CONTEST IS NOT SPONSORED, ENDORSED, ADMINISTERED BY, OR ASSOCIATED WITH INSTAGRAM® IN ANY WAY.

In these Official Rules (“Official Rules”), the term “you,” “your,” and “Participant” refer to persons participating in the Giveaway, and “we,” “us,” “our,” and “BOH” refer to Bank of Hawaii, its parent, subsidiaries, and affiliates.

GAME PERIOD: Giveaway will begin at 10:00 a.m. HST October 23, 2023 (“Begin Date”), and continue through 11:59 p.m. HST October 29, 2023 (“End Date”).

ELIGIBLE PARTICIPANTS: Giveaway is open to all legal residents of the state of Hawaii who are 18 years of age and older as of the Begin Date.  The following individuals are not eligible to enter: officers, directors, independent contractors and employees of BOH ("Sponsor"), Mana Up Hawaii, and each of their respective subsidiaries and affiliated companies as well as any Mana Up Accelerator Program participating businesses and their respective owners, directors, independent contractors and employees, or anyone otherwise associated with the Giveaway; (collectively, "Promotion Entities") and all of their immediate household members (not limited to but including: spouse, parent, child, sibling, in-laws). The Giveaway shall be construed and evaluated solely under applicable state, United States federal, and local laws. The Giveaway is void where prohibited, taxed or restricted by law.

HOW TO ENTER:

To enter Showcase Giveaway, you must:

• Login to your Instagram account.
• Follow Bank of Hawaii’s official Instagram account (http://www.instagram.com/BankofHawaii) and Mana Up Hawaii’s official Instagram account (http://www.instagram.com/ManaUpHawaii).
• Comment on the applicable Showcase Giveaway post with the hashtag #BOHxManaUp and tag a friend.

Limit one (1) entry per Instagram account, per person, per Showcase Giveaway. Multiple comments will not result in additional entries. Any individual found using multiple accounts to enter will be ineligible. Entries for the Giveaway are accepted between the Begin Date and End Date  and the date and time indicated in that post will be used. All times in these Official Giveaway Rules refer to Hawaiian Standard Time/HST and Sponsor’s computer shall be the official timekeeper for matters related to this Giveaway. Sponsor is not responsible for incomplete, lost, stolen, damaged, illegible entries or for address changes of entrants.  Any comment deemed to be offensive or abusive may be deleted and disqualified by Sponsor in its sole discretion without notification to entrant. Sponsor reserves the right to disqualify anyone who disputes any decision made by Sponsor.

PRIZES: (2) winners drawn will each receive the following tickets to the Mana up 2023 Showcase:  (4) tickets to the Marketplace being held on November 9, 2023 and (4) tickets to the Live Concert being held on November 8, 2023, as specified on the social giveaway post. Approximate retail value of each prize is $400. Sponsor reserves the right to limit a winner to one (1) prize during the Game Period.

WINNER SELECTION & NOTIFICATION: A random drawing to determine the winner(s) will be conducted on the timeline indicated on the Giveaway announcement post from among all eligible entries. Each potential winner will be notified via Instagram Direct Message and must respond in the manner instructed in the Direct Message to include their full name, mailing address, and email address as indicated in the Direct Message along with their consent to provide name and contact information to necessary Promotion Entities in order to fulfill prize. Winners’ contact information will be provided to Mana Up who will be handling the fulfillment of the tickets by providing a “promo code” which winners will be instructed to use to obtain the tickets (instructions will be provided in the communication from Mana Up).  If the potential winner cannot be contacted, Sponsor will award the prize to an alternate winner if time permits. The prize will be awarded only to the owner of the Instagram account regardless of who may have commented on the post while accessing the owner’s Instagram account. Prize is not transferrable.

CONDITIONS AND RELEASE OF LIABILITY: By entering the Giveaway, each  participant agrees (a) to release and hold harmless Sponsor and Instagram and their respective parent and affiliated companies and their respective officers, directors and employees as well as the Promotion Entities (“Released Parties”) from any liability for any injury, loss, illness, litigation or damage that may occur directly or indirectly and whether caused by negligence or not from participant’s participation in the Giveaway or acceptance, possession, or use or misuse of the prize or any portion thereof; (b) to indemnify Released Parties from any and all liability for copyright, trademark or other intellectual property infringement claim, right of publicity claim, as well as any other liability resulting or arising from Participant’s Comment and the Giveaway; (c) and hereby acknowledge that Released Parties have neither made nor are responsible in any manner or liable for any warranty, representation, or guarantee relative to the prize; (d) that if selected as the prize winner, to the posting of such Winners’ name on Sponsor’s website and the use by Released Parties of prize winner’s photograph, voice, image, and/or likeness for publicity, promotional, and advertising purposes in any and all media now or hereafter known, throughout the world in perpetuity, without additional consideration, notification, permission or approval; and (e) to be bound by these Official Giveaway Rules and to waive any right to claim any ambiguity or error therein or in the Giveaway itself, and to be bound by all decisions of Sponsor which are binding and final.

GENERAL: Sponsor has the sole power and absolute discretion to terminate or modify any part or all of the Giveaway at any time, for any reason and without prior notice, and to interpret the rules and make decisions regarding the interpretation of the rules. Any modifications to these general rules shall be posted at http://www.boh.com/manaupshowcase. All decisions of Sponsor in respect to this Giveaway and interpretation of these Official Rules are final and legally binding and conclusive in all matters. No participant or winner shall have any right to challenge or contest any decision of Sponsor concerning the Giveaway, its rules, interpretations, determinations, eligibility, verification, timeliness, winners, prizes or any other matter. All federal, state and local laws and regulations apply. Taxes are winner’s sole responsibility. Winners may be required to complete an Affidavit of Eligibility/Liability Release and a Publicity Release at the time the prize is accepted Prize winners may be required to execute additional releases. By entering this Giveaway, winner consents to the use of his/her name, photograph, voice recording and likeness for publicity purposes without additional compensation or permission, except where prohibited by law. Neither Sponsor nor any partner nor any advertising and promotion agencies, nor any service providers are responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any service, or any other error or malfunction, or for late, stolen, lost, postage due, illegible or misdirected entries or mail, or for transactions that are processed late or incorrectly. Entry materials that have been tampered with or altered are void. Activity deemed abusive or improper by Sponsor, in its sole discretion, will result in disqualification from Giveaway. Sponsor reserves the right to substitute a prize of comparable value at its discretion. If Sponsor in its sole discretion, deems that Giveaway cannot be fairly conducted for any reason, it may terminate or modify any part or all of the Giveaway without notice. If any part or all of Giveaway is terminated, Sponsor may select winner from eligible entries received prior to the date of termination. By entering this Giveaway, each entrant accepts and agrees to be bound by these Official Rules. The Bank of Hawaii name is a registered tradename of Bank of Hawaii Corporation.

GIVEAWAY DISPUTES: BY POSTING A COMMENT, PARTICIPANT AGREES THAT (1) ANY AND ALL GIVEAWAY DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS GIVEAWAY OR ANY PRIZES AWARDED SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND EXCLUSIVELY BY THE APPROPRIATE STATE OR FEDERAL COURT LOCATED IN HAWAII; (2) PARTICIPANT HEREBY AGREES AND SUBMITS TO GIVEAWAY JURISDICTION; (3) THAT ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS GIVEAWAY BUT IN NO EVENT ATTORNEYS’ FEES; AND (4) UNDER NO CIRCUMSTANCES WILL PARTICIPANT BE PERMITTED TO OBTAIN AWARDS FOR, AND PARTICIPANT HEREBY WAIVES ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Participant and Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of Hawaii, without giving effect to any choice of law or conflict of law rules (whether of the State of Hawaii or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Hawaii.

WINNERS’ NAMES: For name of winner(s), send a stamped, self-addressed envelope to: Bank of Hawaii Mana Up Showcase Giveaway, Marketing Department, P.O. Box 2900, Honolulu, HI 96846-6000. Requests for Winner’s name to be received by Bank of Hawaii’s Marketing Department.
